In March 2022, as a result of the evidence of the uncomfortable healthcare reality in which patient rights are often violated or forgotten, the Ethics Committee (CEA) of the Catalan Congress of Mental Health Foundation (FCCSM) presented the Conference: “Basic rights in psychiatric admissions” a fi de novament reflexionar i debatre sobre les bases jurídiques sobre les quals fonamentar l’atenció i l’assistència en les xarxes de Salut Mental des de la perspectiva dels drets dels interessats. Així mateix divulgàvem el Document: «Coneixements jurídics bàsics en relació als ingressos involuntaris”, que explicita el marc legal i normatiu a partir de de la Convenció de la ONU (del 2006, ratificada per Espanya el 2008) amb l’efecte regulador i protector que ha de comportar. Establíem d’aquesta manera el marc teòric, legal i també ètic a partir del qual fonamentar la pràctica clínica i assistencial.
In 2023, a new workshop was held with 200 attendees. A new workshop for reflect and debate on current practices and ongoing assistance, with its shortcomings and successes, focusing on the specific changes that must be brought about by the now paradigm that prioritizes patient rights the attention of beneficiaries as individuals. And with the express desire to shed light to discriminate between the clinical and care practices actually underway in our country, those that may already fall within the criteria proposed by the UN Convention, and those others that diminish the value of personal care and the active participation of the beneficiary in their improvement process.
We have tried to differentiate between difficulties or obstacles that arise from structural deficiencies or the established status quo (precariousness of resources, healthcare organization, etc.) and those that stem from healthcare professionals themselves. That is, the resistance to change in the healthcare culture of professionals who easily maintain a position of comfort, ignorance, or passivity when Put patients' rights and their voices first. I have also noted that, despite the difficulties, there are different and proactive stances in the care and respect for the person, which we should promote. The Conference helped to clarify the terms and conditions for these necessary and inevitable changes.
